These Terms of Service govern your access to and use of the Gawergy Audio website, software, plugins, license keys, downloads, digital products, updates, documentation, and related services.

By visiting our website, purchasing a product, downloading a plugin, installing a plugin, activating a license, redeeming a promo code, or using any Gawergy Audio product, you agree to these Terms.

If you do not agree, do not use our website, purchase our products, download our software, activate a license, redeem a promo code, or use our plugins.

1. Who We Are

Gawergy Audio creates and sells audio plugins, software downloads, license keys, and related digital products.

2. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to purchase Gawergy Audio products.

If you use or purchase a product on behalf of a company, studio, school, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

3. Products

Gawergy Audio products may include audio plugins, software downloads, license keys, updates, documentation, presets, demo materials, and related digital content.

Unless stated otherwise on a product page, Gawergy Audio plugins are sold as one-time purchases, not subscriptions.

Supported formats, operating systems, and compatibility requirements will be listed on the applicable product page. At launch, Gawergy Audio may offer macOS VST3 products first. AU, Windows, or other formats may be planned or released later, but they are not guaranteed unless officially listed as supported on the product page at the time of purchase.

4. You Are Buying a License, Not Ownership

When you purchase a Gawergy Audio product, you receive a limited, non-exclusive, non-transferable, revocable license to install and use the software according to these Terms.

You do not own the software. Gawergy Audio and its licensors retain all rights, title, and interest in the software, code, DSP, interface, graphics, names, logos, documentation, website content, and related intellectual property.

5. Permitted Use

Subject to these Terms, you may:

  • Install and use the purchased plugin on devices you personally own or control, within the activation limit
  • Use the plugin for personal music, commercial music, client work, production, mixing, mastering, sound design, and other lawful audio work
  • Export, release, distribute, monetize, and commercially exploit music or audio you create using the plugin
  • Use the plugin in your own creative projects without owing Gawergy Audio royalties

You own your music, audio, recordings, projects, masters, stems, client work, and creative output. Gawergy Audio does not claim ownership of music or audio you create using our plugins.

6. Activation Limits

Each paid license allows activation on up to two devices unless a product page or written agreement says otherwise.

Internet access may be required for first-time activation, license validation, promo code redemption, activation reset, or certain anti-abuse checks.

After successful activation, offline use may be available as long as the local activation remains valid and the license has not been refunded, revoked, disabled, expired, or abused.

Activation limits may be enforced through license keys, activation tokens, machine identifiers, server validation, or other anti-abuse measures.

7. License Keys and Promo Codes

License keys, activation tokens, and promo codes are for the intended recipient only.

You may not share, sell, rent, transfer, publish, leak, trade, sublicense, or distribute license keys, promo codes, activation tokens, download links, or plugin files.

Promo codes may be limited, disabled, revoked, or expired at any time. Promo codes have no cash value and are not refundable.

Gawergy Audio may disable or revoke licenses, promo access, downloads, or activations associated with fraud, abuse, refunds, chargebacks, unauthorized sharing, cracking, bypass attempts, or violation of these Terms.

8. Restrictions

You may not:

  • Share, sell, rent, transfer, sublicense, or resell a license unless Gawergy Audio gives written approval
  • Distribute, upload, leak, mirror, or publicly share plugin files
  • Share license keys, activation tokens, promo codes, download links, or purchase credentials
  • Crack, bypass, disable, tamper with, or avoid activation or licensing systems
  • Reverse engineer, decompile, disassemble, or attempt to extract source code, except where applicable law does not allow this restriction
  • Modify the plugin to remove license checks, copyright notices, branding, security features, or usage restrictions
  • Use the plugin in a way that violates law or third-party rights
  • Claim ownership of Gawergy Audio software, branding, designs, code, assets, or products
  • Use one individual license for a studio, company, team, school, shared workstation, or multiple unrelated users unless approved by Gawergy Audio
  • Use the website, checkout, licensing, or activation systems in a way that is abusive, automated, fraudulent, disruptive, or harmful

9. No License Transfers or Resales

License transfers and resales are not allowed unless Gawergy Audio approves them in writing.

Gawergy Audio may refuse transfer requests for any reason, including fraud prevention, abuse prevention, refund history, chargebacks, unauthorized resale, or support burden.

10. Updates

Gawergy Audio may provide updates, bug fixes, improvements, compatibility updates, or new features at its discretion.

Unless stated otherwise, purchases include updates for the same major version when available, such as 1.x updates for a 1.x product.

Future major upgrades, new products, new formats, expanded compatibility, or additional features may be free or paid at Gawergy Audio’s discretion.

Gawergy Audio is not required to provide updates forever, maintain compatibility with all future DAWs or operating systems, support discontinued systems, or add planned formats by a specific date.

11. Beta, Test, or Pre-Release Versions

If you receive access to a beta, test, preview, pre-release, or experimental version, you understand that it may contain bugs, incomplete features, compatibility issues, crashes, or changes before final release.

Beta, test, preview, pre-release, or experimental products are provided for evaluation and feedback only unless stated otherwise. Gawergy Audio is not responsible for losses, corrupted sessions, lost work, client issues, missed deadlines, or system problems caused by beta or pre-release software, to the maximum extent permitted by law.

12. Compatibility

Supported systems, formats, and DAWs will be listed on the product page.

Compatibility may vary depending on:

  • Operating system
  • DAW or host application
  • Plugin format
  • Computer hardware
  • Audio interface
  • System settings
  • Third-party software
  • Future DAW or operating system updates
  • Future security, signing, or plugin validation changes

Gawergy Audio is not responsible for problems caused by unsupported systems, unsupported DAWs, unsupported plugin formats, operating system changes, DAW changes, third-party plugins, user error, corrupted systems, or incompatible hardware.

Before purchasing, you are responsible for checking the product page and confirming that your system is supported.

13. Support

Support is provided by email only unless Gawergy Audio offers another support channel.

Support may be limited to supported products, supported systems, and active license holders.

We may ask for information such as order email, license key status, DAW, operating system, plugin format, screenshots, logs, crash reports, or steps to reproduce an issue.

Gawergy Audio is not required to provide support for unsupported systems, modified plugin files, cracked copies, shared licenses, revoked licenses, refunded licenses, chargebacked purchases, expired access, or products obtained from unauthorized sources.

14. Payments

Payments are processed by Lemon Squeezy or another authorized checkout/payment provider.

By purchasing, you may also be subject to Lemon Squeezy’s terms, privacy policy, tax handling, payment processing rules, and refund processing timelines.

Prices, taxes, discounts, coupons, availability, and product offerings may change at any time.

Gawergy Audio is not responsible for payment processor delays, card issuer delays, bank issues, currency conversion fees, tax calculations, failed payments, checkout outages, or checkout provider errors, except where required by law.

15. Refunds

Refunds are governed by the Gawergy Audio Refund Policy:

By purchasing a product, you agree to the Refund Policy.

If a refund is issued, your license may be deactivated, activation tokens may be revoked, downloads may be disabled, and you must stop using and uninstall the refunded product.

16. Chargebacks and Payment Disputes

If you have an issue with a purchase, contact Gawergy Audio first at gawergyaudio@atomicmail.io.

Chargebacks, payment disputes, fraudulent purchases, unauthorized payment activity, or abuse of the payment system may result in immediate license suspension, license revocation, download access removal, refusal of future purchases, refusal of support, and fraud review.

17. Product Results and Marketing Claims

Gawergy Audio products are creative tools. We do not guarantee any specific artistic, technical, financial, streaming, commercial, client, professional, or creative result.

We do not guarantee that using our plugins will make your music louder, better, commercially successful, accepted by streaming platforms, approved by clients, comparable to another artist, or superior to any other product.

Any examples, demos, screenshots, videos, presets, marketing statements, or descriptions are for general demonstration and informational purposes only. Results may vary depending on your source material, settings, system, DAW, monitoring, taste, workflow, and skill.

18. Third-Party Services

Our website, checkout, licensing, analytics, diagnostics, support, delivery systems, or payment systems may rely on third-party services.

Gawergy Audio is not responsible for third-party websites, services, outages, policies, terms, security incidents, payment processing delays, or platform changes, except where required by law.

19. Intellectual Property

All Gawergy Audio software, plugin code, DSP, user interfaces, images, designs, logos, names, trademarks, documentation, videos, audio demos, website content, and related materials are owned by Gawergy Audio or its licensors.

You may not copy, distribute, modify, imitate, reverse engineer, republish, scrape, or create derivative works from Gawergy Audio software or assets except as expressly allowed by these Terms or by law.

20. Termination and Revocation

Gawergy Audio may suspend, disable, revoke, or terminate your license or access if you:

  • Violate these Terms
  • Share, resell, leak, crack, bypass, or abuse the software
  • Misuse license keys or promo codes
  • Submit fraudulent purchases
  • File chargebacks without contacting support
  • Use unauthorized, modified, or cracked copies
  • Use the software, website, checkout, licensing, or activation systems in a harmful or abusive way

After termination or license revocation, you must stop using and uninstall the software.

21. Disclaimers

To the maximum extent permitted by law, Gawergy Audio products, website, downloads, license systems, support, documentation, and related services are provided “as is” and “as available.”

To the maximum extent permitted by law, Gawergy Audio disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, compatibility, security, accuracy, and availability.

Gawergy Audio does not guarantee that:

  • The plugin will work with every DAW, system, host, or future update
  • The plugin will be uninterrupted, error-free, crash-free, or bug-free
  • The plugin will meet your personal taste, workflow, expectations, or sound preference
  • The website, checkout, activation, licensing, downloads, or support will always be available
  • Any defect will be corrected by a specific date
  • Your projects, sessions, presets, files, settings, or client work will be protected from user error, host crashes, third-party plugin issues, or system problems
  • Any future format, feature, update, operating system, or DAW support will be released by a specific date

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

22. Limitation of Liability

To the maximum extent permitted by law, Gawergy Audio will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including:

  • Lost profits
  • Lost revenue
  • Lost business opportunities
  • Lost clients
  • Lost data
  • Lost audio
  • Lost projects
  • Corrupted DAW sessions
  • Missed deadlines
  • Failed releases
  • Business interruption
  • Studio downtime
  • Client disputes
  • Cost of replacement software
  • Cost of re-recording, remixing, remastering, or recreating work
  • Damage caused by DAW crashes, host issues, system conflicts, third-party plugins, or operating system changes
  • Any damages arising from use or inability to use the software, website, checkout, activation, licensing, downloads, or support

To the maximum extent permitted by law, Gawergy Audio’s total liability for any claim related to a product, purchase, license, website, download, activation, support interaction, or these Terms will be limited to the amount you paid for the specific product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

23. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Gawergy Audio from any claims, damages, losses, liabilities, costs, and expenses arising from:

  • Your use or misuse of the website or products
  • Your violation of these Terms
  • Your violation of law or third-party rights
  • Your sharing, resale, cracking, bypassing, or unauthorized distribution of the software
  • Your music, audio, projects, services, client work, or commercial use of the plugin
  • Your use of unsupported systems or modified software
  • Your use of cracked, unauthorized, or improperly obtained copies

24. Informal Dispute Resolution

Before filing a claim, you agree to contact Gawergy Audio at gawergyaudio@atomicmail.io and attempt to resolve the dispute informally.

Your message should include your name, order email, product, issue, requested resolution, and any relevant details.

Gawergy Audio will attempt to respond in a reasonable time. This section does not limit either party’s right to seek urgent relief where legally allowed.

25. Individual Claims and Class Action Waiver

To the maximum extent permitted by law, you and Gawergy Audio agree that disputes must be handled only on an individual basis and not as part of a class, collective, consolidated, private attorney general, or representative action.

Some jurisdictions do not allow class action waivers or representative action waivers, so this section may not apply to you.

26. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law rules.

To the maximum extent permitted by law, any dispute relating to these Terms, the website, products, licenses, downloads, support, or purchases will be handled in the state or federal courts located in California.

27. Consumer Rights

Nothing in these Terms limits rights that cannot legally be waived under applicable consumer protection laws.

If any part of these Terms is found unenforceable, the remaining parts will remain in effect to the maximum extent permitted by law.

28. Changes to These Terms

Gawergy Audio may update these Terms from time to time.

The “Effective Date” above will reflect the latest update. Continued use of the website or products after changes are posted means you accept the updated Terms.
